Welcome

These Terms & Conditions apply to the SMAPS Move More Membership.

By joining the Move More Membership, adding your payment details, completing an online sign-up form, ticking the website agreement checkbox, or otherwise agreeing to begin the membership, you confirm that you have read, understood and accepted these Terms & Conditions and the SMAPS Privacy Policy.

The Move More Membership is designed to support consistency, confidence and regular movement through SMAPS Mat and Reformer Pilates classes.

1. Definitions

In these Terms & Conditions:

SMAPS, we, us or our means SMAPS Pty Ltd.

Member, you or your means the person who has joined the Move More Membership.

Move More Membership means the weekly direct debit membership that gives eligible members access to Mat and Reformer Pilates classes at SMAPS, subject to these Terms & Conditions.

Membership Fees means the weekly amount payable for the Move More Membership.

Minimum Commitment means the first 12 weeks of the membership.

Payment Provider means Stripe or any other third-party payment provider used by SMAPS to process membership payments.

Payment Method means the payment option approved by SMAPS for your membership, which may include direct debit, card payment, bank account payment, upfront payment, or another payment arrangement approved by SMAPS in writing.

2. Membership Inclusions

The Move More Membership includes unlimited access to SMAPS Mat and Reformer Pilates classes during SMAPS’ normal scheduled timetable, generally Monday to Saturday, subject to:

This membership does not include:

The membership is for one person only. It cannot be shared, transferred, gifted, paused for another person, or used by anyone other than the named member.
Requests to pause, suspend or cancel a membership due to illness, injury, travel, hardship or other circumstances will be managed in accordance with the pause, cancellation and minimum commitment clauses in these Terms & Conditions.

3. Membership Fees

The Move More Membership is $66 per week, paid in advance by direct debit through our Payment Provider, unless another payment arrangement has been approved by SMAPS in writing.
SMAPS may, at its discretion, allow a member to pay for the 12-week Minimum Commitment upfront in one lump sum.
Upfront payments do not remove or reduce the 12-week Minimum Commitment and are subject to the same booking, cancellation, pause, refund and membership terms.
All prices are in Australian dollars and include GST where applicable.
You are responsible for ensuring your payment details are correct and that sufficient funds are available on each scheduled payment date.

4. Direct Debit Authority

By joining the Move More Membership, you authorise SMAPS and our Payment Provider to debit your nominated payment method for the weekly Membership Fees and any other fees payable under these Terms & Conditions.

Payments may be processed from a nominated card, bank account, or other approved payment method made available through our Payment Provider.

SMAPS does not store your full card or bank details. Payment details are handled securely by the Payment Provider.

5. Minimum 12-Week Commitment

The Move More Membership has a strict 12-week minimum commitment.
By joining, you agree to maintain and pay for the membership for at least 12 weeks from your membership start date.
If you request to cancel before the 12-week Minimum Commitment has been completed for change of mind or any non-medical reason, the remaining balance of the Minimum Commitment will become payable before your membership is confirmed as ended, unless otherwise agreed by SMAPS in writing or required by law.
If you are unable to complete the 12-week Minimum Commitment due to significant accident, injury, illness, surgery or medical reasons, you must provide written notice to SMAPS and may be required to provide a letter or certificate from your doctor, treating practitioner or relevant health professional. Once appropriate documentation is received, SMAPS may approve a membership pause or cancellation from an agreed date.
Approved medical cancellations or pauses are considered by SMAPS in good faith and in accordance with Australian Consumer Law and these Terms & Conditions.

6. Cancellation After the Minimum Commitment

After the 12-week Minimum Commitment has been completed, you may cancel your membership by providing two weeks’ written notice by email to info@smaps.com.au.
Membership Fees remain payable during the two-week notice period.
Cancellation requests must be sent by email. Verbal requests, social media messages, text messages, or conversations with staff do not automatically cancel your membership.
Your membership will remain active until the end of the notice period.

7. Failed or Overdue Payments

If a weekly payment fails, is dishonoured, or becomes overdue, you remain responsible for the outstanding amount.
SMAPS may pause your membership access and future bookings until your account is up to date.
The Payment Provider or your bank may charge fees for failed, dishonoured or resubmitted payments. These fees are outside SMAPS’ control and may be passed on to you where applicable.
If SMAPS introduces a specific administration fee for failed or overdue payments, this fee will be communicated to members before it applies.
Failed payments do not cancel your membership or reduce the Minimum Commitment.
If payments remain overdue after reasonable attempts to resolve the issue, SMAPS may cancel or suspend your membership and seek payment of any outstanding amounts.

8. Booking Classes

All Mat and Reformer Pilates classes must be booked in advance online or via phone.

Membership does not guarantee a place in your preferred class, day or time.

Classes are subject to availability and may book out.

Members are responsible for managing their own bookings and cancelling any class they can no longer attend.

9. Late Cancellation and No-Show Policy

All class bookings are subject to the SMAPS booking, late cancellation and no-show policies.
SMAPS currently requires at least 6 hours’ notice to cancel a class booking.
The Move More Membership covers eligible attended Mat and Reformer Pilates classes. It does not remove the responsibility to cancel bookings with appropriate notice.
Late cancellations or no-shows may incur a fee of up to 50% of the relevant casual class price and/or may result in future booking access being restricted.
SMAPS understands that genuine emergencies can happen and may consider these on a case-by-case basis.
Repeated late cancellations, no-shows, or booking misuse may result in your membership being reviewed, restricted, suspended or cancelled.

10. Class Suitability and Instructor Guidance

SMAPS reserves the right to recommend or require a different class, service or pathway if we believe a class is not suitable for your current needs, safety, experience level, injury status, pregnancy status, or health presentation.

Our instructors may modify exercises, ask you to stop an exercise, or recommend clinical guidance if needed.

If SMAPS reasonably believes that participating in a class may place you, another client, or a staff member at risk, we may refuse or restrict class participation.

11. Health and Medical Responsibility

You acknowledge that Pilates and exercise involve physical movement and carry inherent risks.

You are responsible for exercising within your own ability and letting your instructor know about any injury, illness, pregnancy, pain, surgery, medical condition, or change in health that may affect your ability to participate safely.

You should seek medical advice before starting or continuing Pilates if you are unsure whether it is safe for you.

You agree to stop exercising and notify your instructor immediately if you experience pain, dizziness, faintness, chest pain, unusual shortness of breath, or any symptoms that concern you.

SMAPS services do not replace medical advice, diagnosis or treatment.

12. Member Conduct

SMAPS is committed to providing a warm, respectful, inclusive and safe environment for all clients, members, staff and contractors.

SMAPS may suspend or cancel a membership if a member seriously or repeatedly breaches these expectations.

13. Phones, Photos and Privacy in the Studio

Members must respect the privacy and comfort of others while at SMAPS.
You must not photograph, film or record another person without their clear permission.
SMAPS may take photos or videos from time to time for marketing, social media, website, educational or community purposes. SMAPS will take reasonable steps to notify clients when filming or photography is occurring, and identifiable images of clients will only be used with consent.
If you do not wish to be photographed or filmed, please let the SMAPS team know.
SMAPS may ask you to stop filming or using your phone if it impacts the privacy, comfort, safety or experience of others.

14. Membership Pauses or Holds

The Move More Membership is designed as an ongoing weekly membership and is not automatically placed on hold for holidays, missed classes, busy periods, or change of mind.

SMAPS may consider pause requests in exceptional circumstances, such as significant injury, illness, surgery, extended travel, or hardship.

Pause requests must be made in writing before the requested pause period.

SMAPS may request supporting information, such as a medical certificate.

Approved pause periods do not reduce the 12-week Minimum Commitment. Any paused time may extend the Minimum Commitment period.

Pause requests are considered at SMAPS’ discretion and are not guaranteed.

15. Timetable, Instructor and Class Changes

SMAPS will make reasonable efforts to maintain a consistent timetable, but classes, instructors, times and availability may change from time to time.

Changes may occur due to staff availability, illness, holidays, demand, public holidays, maintenance, safety, emergencies, or other operational needs.

A change to the timetable, instructor, or your preferred class time does not automatically entitle you to a refund, cancellation, extension or compensation, except where required by law.

If SMAPS makes a significant change that materially affects your ability to use the membership, we will work with you in good faith to find a fair solution.

16. Studio Closures and Public Holidays

SMAPS may close or run a reduced timetable on public holidays, during planned holiday periods, for maintenance, emergencies, staff illness, safety reasons, or circumstances beyond our reasonable control.

Temporary closures or reduced timetables do not automatically entitle members to a refund, suspension, credit or extension, except where required by law.

17. Refunds

Membership Fees are not refunded for:

Nothing in these Terms & Conditions limits your rights under Australian Consumer Law or any other law that cannot be excluded.

18. Changes to Membership Fees or Terms

SMAPS may update Membership Fees, membership inclusions, policies, or these Terms & Conditions from time to time.

Any material change will be communicated with reasonable notice.

Fee increases will not apply during your 12-week Minimum Commitment unless required by law or agreed with you.

After the Minimum Commitment, if you do not wish to accept a fee increase or material change, you may cancel your membership in line with the cancellation terms.

The current Terms & Conditions will be available on the SMAPS website.

19. Cancellation or Suspension by SMAPS

SMAPS may suspend, restrict or cancel your membership if:

Where appropriate, SMAPS will give you an opportunity to resolve the issue before cancelling the membership.

In serious situations, SMAPS may suspend or cancel access immediately.

20. Minors

Members under 16 years of age must have parent or guardian consent to join the Move More Membership.

All members under 16 years of age must be accompanied by an adult or guardian while attending SMAPS.

A parent or guardian may be required to complete the sign-up process and accept responsibility for payment and compliance with these Terms & Conditions.

SMAPS may refuse or restrict participation for minors where we believe a class is not suitable or safe.

21. Personal Belongings and Lost Property

Members are responsible for their own belongings while at SMAPS.

SMAPS is not responsible for lost, stolen or damaged personal items, except where required by law.

Lost property may be held for a reasonable time and then donated, disposed of, or otherwise managed by SMAPS.

22. Privacy

SMAPS collects and uses personal information to manage memberships, bookings, payments, communication, services, safety and business operations.

Your personal information will be handled in accordance with the SMAPS Privacy Policy.

You agree to keep your contact details up to date.

SMAPS may contact you by email, SMS, phone or other electronic means about your membership, bookings, payments, studio updates, policies and services.

You may opt out of marketing communications where available, but operational messages relating to your membership may still be sent.

23. Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian Consumer Law or other applicable laws.

Subject to those rights, you acknowledge that participating in Pilates and physical activity involves inherent risks, including the risk of injury.

You participate at your own risk and agree to exercise within your own capacity.

To the extent permitted by law, SMAPS is not liable for loss, injury or damage arising from:

Nothing in this clause limits liability that cannot lawfully be excluded.

24. Australian Consumer Law

These Terms & Conditions are intended to operate alongside your rights under Australian Consumer Law.

If any part of these Terms & Conditions is inconsistent with a right that cannot legally be excluded, that right will continue to apply.
